It seems that Kim Kardashian isn’t joking when it comes to her image, as she has taken legal action against the well known clothing brand, Old Navy. The reason behind Kim Kardashian’s decision to sue Old Navy is an ad that Old Navy has used to promote their clothing line. According to Kim, the company decided to use a lookalike to confuse the consumers into thinking she’s endorsing the product.
The reality TV diva has sued Old Navy and its parent company The Cap Inc. for allegedly violating her publicity rights with the ad used to promote the label. The ad was featured on Old Navy’s YouTube channel and ranked a couple of million visitors.
Kim Kardashian has become quite an entrepreneur lately creating her own fragrance line in addition to her own clothing store and shoe line, and she is thought to be one of the most searched for celebrities at this moment, so no wonder Kim’s defending her popularity.
The ad used by Old Navy and titled “Super CUTE” features a woman that looks like Kim Kardashian, but the resemblance isn’t striking. However, Kim states that the label used her lookalike to promote the clothing line and that can lead consumers into thinking she was affiliated with Old Navy.
With 8 million followers on Twitter and more than 5 million fans on Facebook, Kim Kardashian can definitely back-up her celebrity status, but could her fame and resemblance to the woman in the ad be enough proof to convince the judge that she’s right?
According to OMG, the lawsuit states that Kim “has invested substantial time, energy, finances and entrepreneurial effort in developing her considerable professional and commercial achievements and success, as well as in developing her popularity, fame, and prominence in the public eye,” and she’s seeking damages for the ad that features her lookalike. Kim is asking for an unspecified amount in damages, but it’s rumored that we’re talking about millions.
